1. The Promoter

a. The promoter is Moneytech FinancePty Ltd ACN 112 110 906 of Leve 7, 80 PacificHighway, North Sydney NSW 2060, competition permit numbers ACT TP22/02018.1, NSW TP/02144, SA T22/1437

2. The Competition

a. The Competition is the“Moneytech Million Points Competition ” open to eligible applicants for the duration and on the terms set out in these Terms and Conditions.

3. Conditions of Entry

a. Eligibility information and the Prize offered in the Competition form part of these Terms and Conditions as conditions of entry. A party that renders themselves an Eligible Entrant is deemed to have accepted these Terms and Conditions.

b. Employees of the Promotor, its Related Bodies Corporate and their immediate family members are not permitted to enter and will not be Eligible Entrants.

c. Employees of any suppliers whose product is included as part of the Prize are not permitted to enter and will not be Eligible Entrants.

d. All Eligible Entrants who participate in the Competition consent to their name being announced in accordance with clause 6 if they are selected as the Prize winner, and their details being provided in accordance with clause 7(a)if they are selected as the Prize winner.

e. The Prizewinner, by accepting the Prize, consents to the use of their name, business name and image for promotional and marketing purposes in favour of the Promoter.

4. Eligibility

a. Eligible Entrants will be those who, during the Promotion Period:

i. Execute and commence aMoneytech Facility;

ii. As a result of that execution and commencement, they will automatically be entered into the draw titled “Moneytech Business Flyer Competition Draw” as “applicant”.

iii.    Sign up to, or be a current member of, the Virgin Australia Business Flyer Program. Additional membership terms and conditions apply, which can be accessed here.

b. If an entrant provides the Promoter with incomplete or inaccurate information or does not satisfy the Eligible Entrant requirements, the entry will be void.

c. Any costs associated with accessing the Competition is the responsibility of each entrant.

d. A party who complies with these eligibility requirements will be able to enter the Competition once.

5. Duration

a. The Promotion Period commences 14 February 2023 at 12.01am AEST and closes 31 March 2023 at 11:59 pm AEST.

6. Selection of "Winner"

a. The Prize winner will be drawn from the pool of Eligible Entrants within seven (7) days of the Promotion Period ending.

b. The draw will take place at the Promoter’s head office located at Level 7, 80 Pacific Highway, North Sydney NSW 2060 at 11.00 am AEST on 21 April 2023 by a random computer-generated draw. The Prize winner need not be present at the draw.

c. There will only be one (1) Prize winner selected from the Eligible Entrants from the Promotion Period.

d. The Promoter reserves the right to draw additional reserve entries and record them in case an ineligible entrant is drawn, or if the Prize is not claimed by the initial Prize winner in accordance with this clause.

e. The Prize winner will be contacted by the Promoter via email and telephone as soon as possible after the draw at 6(b) but in any event within seven (7) days. The Promoter will make at least four (4) attempts to contact the Prize winner within fourteen (14) days after the draw at 6(b).

f. The Prize winner (including any unclaimed Prize winner) will be announced on the Promoter’s website within 48 hours of the draw at 6(b) at www.moneytech.com.au .

g. The Prize winner must be able to provide a current valid Australian Passport or Australian Driver’s Licence (or other valid photograph identification acceptable at the Promoter’s sole and unfettered discretion) in order to accept the Prize.

h. The Prize winner will have fourteen (14) days to claim the Prize. If the Prize has not been claimed by the Prize winner before 5.00 pm AEST on the fourteenth (14^th) day after the draw at 6(b), a reserve Prize winner pursuant to 6(d) will be announced as the Prize winner and contacted in accordance with this clause. The reserve Prize winner will be drawn at the Promoter’s head office located at Level 7, 80 PacificHighway, North Sydney NSW 2060 at 11.00 am AEST on TBC 2023 and notified in accordance with clause 6(e) and (f[SJ(3] ). The reserve Prizewinner will have fourteen (14) days from to claim the Prize. If the Prize has not been claimed by the reserve Prize winner before 5.00 pm AEST on the 28^thday after the draw at 6(b), a further reserve Prize winner pursuant to 6(d)will be announced as the Prize winner, and contacted in accordance with this clause.

i. The Promoter’s decision as to the Prize winner is final, and the Promoter will not enter into correspondence regarding the result of the Competition.

7. The Prize

a.    The Promoter will contact VelocityFrequent Flyer Pty Ltd or its Related Corporate Bodies with the following information as soon as reasonably practicable after the Prize winner has accepted the Prize and the requirements of clause 6 have been met:

i.    The Prize winner’s ABN Number;

ii.    The Prize winner’s contact details.

b. The Prizewinner must take the Prize as offered. The Prize cannot be sold, used, donated or given away as part of another promotion or competition, and is not transferable or exchangeable and cannot be redeemed as cash or travel credit.

c. The Prizewinner is responsible for holding or obtaining a Virgin Australia BusinessFlyer Membership during the Promotion Period.

d. In the event that the Prize cannot be fulfilled for any reason within one (1) calendar month of the draw, the Promoter agrees to provide the Prize winner with the wholesale Australian dollar equivalent of the Prize.

e. Taking the Prize is subject to any terms and conditions required by Velocity Frequent FlyerPty Ltd or its Related Bodies Corporate, set out here.

8. Release

a. To the extent permitted by law, the Promoter is not responsible or liable for:

i. Inaccurate or incorrect transcription of entry information;

ii. Purportedentries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received by are late, illegible, incomplete, sent with insufficient postage, or sent other than as directed in the entry instructions;

iii. Any problems or technical failures of any kind, including but not limited to malfunction of any telephone network or lines, computer online systems or network server or providers, computer equipment or software;

iv. The unavailability or inaccessibility of any service whether or not caused by traffic congestion at the Promoter’s website or otherwise;

v. Unauthorised human intervention in any part of the Competition;

vi. Electronicor human error which may occur in the administration of the promotion;

vii. Any loss suffered or sustained to a person or property and including but not limited to consequential (including economic) loss in connection with the arrangement for supply, or the supply, of any goods or services by any person to a Prize winner and, where applicable, to any family/persons accompanying a Prize winner;

viii. Any theft, unauthorised access or third-party interference;

ix. Any variation in the value of the Prize.

b. The Promoter, and Velocity Frequent Flyer Pty Ltd and its Related Bodies Corporate, accept no responsibility for any tax implications that may arise from accepting the prize. Entrants should seek independent financial advice.

c. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act.

d. Except for any liability that cannot by law be excluded, the Promoter (including its Related Bodies Corporate and respective officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury or any loss or damage, including loss of opportunity, whether direct, indirect, special or consequential arising in any way out of anything set out at clause 9(a).

e. The Prizewinner takes the Prize at his/her own risk.

f. ThePromoter shall not be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm, national or global pandemics and/or the implementation of regulation, directions, rules or measures being enforced by government or embargo including but not limited to Government imposed border lockdowns or other event beyond the reasonable control of the Promoter.

9. Personal Information

a. All entries become the sole property of the Promoter. The Promoter may collect an entrant’s personal information so that it may process that entry, administer this Competition, and contact the entrant regarding information on products or services that may be of benefit or interest to an entrant. The Promoter may communicate personal information to external provider and organisations to which it may outsource certain functions(including Velocity Frequent Flyer Pty Ltd). b. 10. General

a. ThePromoter reserves the right to amend these Terms and Conditions or to cancel, alter or amend the Competition at any stage if it is deemed necessary in the sole and unfettered discretion of the Promoter or if circumstances arise outside of its control without awarding any compensation subject [SJ(1] to relevant regulatory authority.

b. The failure of either party to enforce any provision of these Terms and Conditions shall not be treated as a waiver of that provision, nor shall it affect that party’s right to subsequently enforce that provision. If any provision of these Terms and Conditions shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

c. These Terms and Conditions shall be governed by the laws of New South Wales and are subject to the non-exclusive jurisdiction of the courts in that state.

d. The Promoter may licence and/or assign all or any part of its rights, title,interest or obligations under these Terms and Conditions without the consent of any other party (including without the consent of Eligible Entrants).

e. AnEligible Entrant may not assign, transfer or licence any of its rights, title or interest under these Terms and Conditions.

f. The rights and obligations of the parties will not merge on completion of any transaction under these Terms and Conditions and they will survive the execution and delivery of any assignment or other document entered into for the purpose of implementing any transaction under these Terms and Conditions.

11. Definitions

a. Competitionmeans thecompetition as described at clause 2 for the Prize.

b. EligibleEntrant means an entrant under clause 4 who mustbe over the age of 18.[SJ(1] 

c. MoneytechFacility means a finance facility with the Promoter or anyof its Related Bodies Corporate.

d. Promoter means theparty at clause 1.

e. PromotionPeriod means the period set out at clause 5.

f. Prize means1,000,000 Velocity Points.

g. RelatedBodies Corporate has the meaning given to it in the Corporations Act 2001 (Cth).

h. Terms and Conditions means these terms and conditions called “Competition Terms and Conditions: Conditions of entry into “Moneytech Business Flyer Competition”.
